Terms and Conditions

DEFINITIONS:

In these Terms & Conditions:

  • Movement, we, us, or our refers to the applicable legal entity operating your nominated club, as listed in the “About Us” section.

  • You or Member refers to the person who has entered into a membership agreement with Movement Health Clubs.

  • Club or Location means the specific Movement Health Club facility where your membership is primarily held.

  • Home Club means the location you nominated at sign-up and where your agreement is administered.

  • Membership refers to your ongoing agreement to access and use our facilities and services under the terms described in this document.

  • Add-On means an optional additional membership product or service (such as Reformer Pilates, Creche, Progress Plus, or Progress Challenge) that may only be purchased in conjunction with an active general access Membership. Add-Ons are billed separately and subject to their own terms.

  • Minimum Term refers to the minimum contract period selected at sign-up (e.g. 3, 6, or 12 months).

  • Cooling-Off Period means the 14-day period after entering this agreement during which you may cancel without penalty (subject to administration fees).

  • Direct Debit Provider means the third-party financial institution processing your ongoing membership payments.

  • Access Device refers to your PIN code, key tag, or app-based system used to gain entry to our facilities.

  • Business Days means Monday to Friday excluding public holidays in the state where your Home Club is located.

Agreement & Acceptance

By entering into a Membership with us or accessing any Club, you acknowledge and agree to be bound by these Terms & Conditions, including any documents incorporated by reference. These Terms apply uniformly to all Movement Health Clubs and prevail over any prior or contemporaneous representations, whether oral or written.

The agreement is binding on each party and the heirs, successors and assigns of each of the parties.

The terms of this agreement prevail under the renewal or extension of the initial membership shown on the front page of your membership agreement and are not limited to the term of the initial membership.

Membership is subject to current company policies, rules and limitations and to any future changes to those policies, rules and limitations.

Memberships are assignable to a new owner of the business, at the sale or assignment of the business.

Communication:

All enquiries relating to your Membership or the services provided under this Agreement must be directed to your Home Club, whose contact details are listed at www.movementhealthclubs.com.au.

You are responsible for ensuring that your contact details (including your email address, mobile phone number, and residential address) are accurate and up to date at all times.

By entering into this Agreement, you consent to us contacting you via email, SMS, phone call, or post regarding matters relating to your Membership, including billing, changes to terms, service updates, and operational notices. These communications form part of our contractual relationship with you.

Cooling off period:

You may cancel this agreement at any time within 14 Days from signing this agreement (referred to as the Cooling Off Period) by delivery of notice in writing to your Home Club.  A non-refundable administration fee of $75 applies.

Upon cancellation within the Cooling Off Period, we will refund the full amount paid for any unused services or products and returned products.  Any refund will be paid via EFT within 10 business days. No cash refunds will be issued.

Membership Types & Fees

Membership fees may be paid via Direct Debit or Paid-In-Full at the time of joining. All fees are inclusive of Goods and Services Tax (GST). Unless explicit on your membership agreement, Membership pricing is subject to an annual review and may be increased by up to 3% or the Consumer Price Index (CPI), whichever is greater. We will provide a minimum of 30 days’ notice before any such change takes effect.

Any discounted rates (including Mates Rates promotions) are time-limited and will revert to the prevailing standard rate unless otherwise stated.

Memberships are not refundable except as provided by law.

Suspension of Membership (Freeze)

A Member may suspend their Membership for up to three (3) months within any 12-month period, in minimum increments of one (1) week.

Requests must be made in writing no less than five (5) Business Days before the next billing cycle.

Suspension automatically extends the Minimum Term unless expressly agreed in writing.

Backdated suspensions may be granted only where explicitly stated in your individual Membership Agreement. Where applicable, Members may request one (1) backdated suspension per calendar year starting up to 14 days prior to the suspension request date. The request must specify the exact dates to be backdated and must be submitted in writing. A backdated suspension cannot include any day on which the Member accessed the Club. Approval is at the discretion of Movement and subject to verification against attendance records.

Cancellation of Membership

Following the expiry of the Minimum Term, Members may cancel their Membership by providing at least 30 days’ written notice. The effective cancellation date will be 30 days from the date we receive your notice.

Cancellation during the Minimum Term may incur a cancellation fee of $150.

Add-on services may be cancelled at any time with written notice and will take effect at the end of the current billing cycle. No minimum notice period applies to add-on cancellations, unless otherwise stated in the specific terms of the add-on. Add-on access will remain valid until the end of the paid period unless otherwise requested.

Direct Debit & Failed Payments

You are responsible for ensuring that adequate funds are available in your nominated account on the scheduled payment date. Failed payments incur a Failed Payment Fee of up to $10.

If payment is not received within 7 days of the due date, we reserve the right to suspend your access until the account is brought up to date. In the event of continued non-payment, we may engage a third-party collection agency and recover associated costs.

By agreeing to Direct Debit, you authorise Movement to adjust the debit amount in accordance with changes to membership pricing as outlined in this agreement, provided that notice has been given and you acknowledge that such changes may occur without requiring a new Direct Debit Request to be signed.

We reserve the right to change direct debit billing providers.

TRANSFERs

Memberships can be transferred to another person while still under the initial minimum term contract period.  Transferees of a membership are subject to the same terms and conditions as you under this agreement. Transferees may not be entitled to concession rates or discounted rates.

Members under 18 Years old

Where the Member is under 18 years of age, their parent or legal guardian agrees to be jointly and severally liable for the Member’s obligations under this agreement.

Members under the age of 18 years old must:

1.       Have your membership agreement co-signed by an adult guardian as a guarantor for your obligations under this agreement. 

2.       Undertake an induction program prior to commencing any activities within the club.

3.       Attend the club only under the supervision of another adult member, staff member or qualified fitness practitioner

We reserve the right to refuse membership, provision of services and/or use of the facilities, whether on a permanent or temporary basis, to any person under the age of 18 years or to stipulate terms and conditions applicable to any person under the age of 18 years, including the payment of any additional fees attendant thereon.

We reserve the right to refuse entry and/or to cancel membership for breach of the agreement, misconduct, damage to equipment, inappropriate behaviour or drug use, including where circumstances so warrant, without notice or warning.

Facilities and Services

We reserve the right to remove, delete or replace equipment and/or services at our club.  We also reserve the right to vary equipment, services and hours of operation at our club.

Some products, equipment or services may not be included in all memberships and may require you to hold a particular membership or pay an additional fee eg creche services, personal training sessions, reformer classes.

We will not be liable for any failure or delay in performance of our obligations under this Agreement where such failure or delay is caused by events beyond our reasonable control, including but not limited to natural disasters, government restrictions, pandemics, equipment failure, or acts of war.

We reserve the right, in the event of permanent closure of the club which you have joined, to transfer your membership to another one of our clubs within 25 kilometres of the closed club. If there is no club within 25 kilometres, you have the right to cancel your membership.

If your club has a swimming pool or sauna, the swimming pool or sauna must not be accessed at any time that the facility is unstaffed. 

If your membership entitles you to reciprocal access at other Movement Health Clubs it will be noted in Special Conditions on this membership agreement.  Access to other clubs is subject to “reasonable use” where your attendance at other clubs does not exceed your attendance at your home club.

Movement Health Clubs uses CCTV monitoring for safety and security. By entering our facilities, you consent to being recorded. Footage may be used to investigate breaches of these Terms.

Access Devices & Entry Conditions

Access Devices are non-transferable and must be used only by the Member to whom they are issued.

Sharing, lending, or misuse of Access Devices constitutes a serious breach and may result in immediate suspension or termination of Membership.

A fee may be charged for the replacement of lost or damaged devices.

You are responsible for ensuring entry is secured and unauthorised access is not granted to others. Penalties including fees and the cancellation of your membership do apply if you do not scan in or if you allow another person to enter without scanning in.

Club Conduct & Member Responsibilities

Members must comply with all posted signage, safety notices, equipment instructions, and staff directions.

You must behave in a respectful and responsible manner at all times. Abusive, threatening, unsafe, or unlawful behaviour may result in immediate suspension or termination of your Membership.

You must wear suitable clothing and footwear and ensure equipment is wiped down and returned after use.

You must not attend the Club while under the influence of drugs or alcohol.

Liability for Property

We will not be liable for any personal property that is damaged, lost, or stolen while on our premises, including in lockers, training areas, change rooms, or car parks, unless such loss or damage is caused by a deliberate or negligent act of Movement or its personnel. This exclusion of liability applies to all personal items, including motor vehicles and their contents.

Any items left in lockers overnight will be removed and held at reception for a period of two (2) weeks. Unclaimed items may be donated to charity thereafter.

You are responsible for the cost of repair or replacement of any property damage caused by you or your guest, whether deliberate or accidental.

Mates Rates

Mates Rates discounts or membership extensions are applied at our discretion, are non-transferable, and expire 12 months after activation. Suspensions do not pause or extend the Mates Rates period. At expiry, your pricing will revert to the standard contract rate.

Physical Condition/Medical Advice

It is up to you to let us know if you have any medical or physical condition which might prevent or affect your use of our facilities.

By entering into this agreement you are representing that you have no such adverse medical or physical condition and that you are not aware of any health or medical reason why you should not use our facilities and services.

You also acknowledge that we have not given you medical advice and cannot in the future give you medical advice in respect of your condition and your ability to use the facilities.

You should check with your doctor before using the facilities if you have any concerns in that regard.

Health & Risk Acknowledgement

You acknowledge that:

  • You are medically and physically fit to participate in exercise.

  • You participate at your own risk.

  • Our staff are not qualified to provide medical advice.

  • You release us from liability for any injury, loss, or damage caused by your participation, except where caused by our gross negligence.

Privacy Policy

Your personal information is handled in accordance with our Privacy Policy, available at movementhealthclubs.com.au/privacy. This includes how we collect, store, and use your personal and health information.

Changes to These Terms

We may update these Terms & Conditions from time to time. The latest version will always be available at movementhealthclubs.com.au/membership-terms-and-conditions. Material changes will be communicated with 30 days’ notice. Continued use of the Club after updates constitutes acceptance.

LEGAL ENTITY DISCLOSURE

Movement Health Clubs is a group of fitness centres operated by different legal entities across NSW and QLD. These Terms & Conditions apply to all locations. For clarity:

  • Beenleigh is operated by Gym4 Pty Ltd ABN 12 345 678 901

  • Casuarina is operated by Casuarina Rec Club Pty Ltd ABN 98 765 432 109

  • Tweed is operated by Integrated Fitness Group Pty Ltd ABN 11 223 344 556

  • Cornubia is operated by The Temple Fitness Group Pty Ltd ABN 55 667 889 001

References in these Terms to “Movement”, “we”, “our”, or “us” refer to the relevant entity listed above, depending on the member’s primary club.

GOVERNING LAW

These Terms are governed by the laws of Queensland and New South Wales, depending on your Home Club location.
